Carter found not guilty of Sexual Abuse in the Third Degree

A 12-member jury found Marcell Devon Carter not guilty of Sexual Abuse in the Third Degree on Jan. 15 following a two-day trial at the Franklin County courthouse.

     The trial stemmed from allegations following a July 13 incident in which the prosecution’s primary witness, age 19, claimed she was raped by force against her will by Carter, 18. The incident in question occurred at an apartment in Hampton, and preliminary investigation led to Carter’s arrest on July 19 after he turned himself in to Hampton Police. According to Carter’s court-appointed lawyer, Richard Tompkins, Jr., the defense never denied a sexual interaction took place between the two individuals.
